A red car sped through a light that had just turned red and crashed into a blue car The driver of the blue car brought a civil suit against the driver of the red car. (a) At the trial the plaintiff called Officer Johnson as a witness who testified that when he arrived upon the scene, he questioned a woman who was standing on the corner when the accident occurred. He testified that she excitedly replied to his questions by stating that “The red car ran through the red light.” (b) At the trial the plaintiff then proceeded to ask Officer Johnson about a young man who was riding his bike and had stopped for the red light. Officer Johnson had written into his police report that “the young man stated that the red car ran the light.”(c) At the trial the plaintiff called as his second witness the ex-girlfriend of the defendant who was a passenger in the red car when the accident occurred. She testified that she told the defendant just before the accident that “I am closing my eyes and holding my breath because of how fast you are going.”(d) As his final witness at the trial, the plaintiff called Doctor Kennedy who had examined the plaintiff following the accident.
