Mаnufаcturer Apex designed аnd manufactured a “Ultimate Blender,” which it sоld thrоugh retail stоres throughout the country. The ultimate blender consisted of three components: a base that houses the motor, a glass container for liquids with mixing blades inside on the bottom, and a removable cover for the container to prevent liquids from overflowing during mixing. Apex provided a brochure that came with the Ultimate Blender stating that it is, “perfect for making all of your favorite cold drinks, like mixed fruit drinks and milk shakes, and its even crushes ice to make frozen drinks. There was a warning label that cautioned, “Do not fill beyond 2 inches of the top.” Retailer sold one of the Ultimate Blenders to Paula. Paula had bought the blender because she had a ranch near the manufacturing plant and wanted to support local business. Paula following a receipt for vegetable soup that called for thickening the soup by blending the vegetables. After preparing the vegetables, Paula put them in the Ultimate Blender. Paula filled the glass container to the top with hot soup, placed it on the base, put the cover on top, and turned the blender at the highest speed. The high-speed rotation of mixing blends forced the contents to the top of the container, which pushed the cover off the Ultimate Blender. The contents splashed on her. Paula received severe burns on her face and hands from the hot liquid. The retailer had no knowledge this could occur, nor could they tell by observing the product before they put it on the shelf. Had a lock been installed by the manufacturer, this injury would not have occurred. Apex’s manufacturing plant could only be accessed through one road. If they put a road at the back of the plant, it would give Apex immediate access to the freeway. To create the road, they blasted twice a day. The blasting sent out huge vibrations at least two miles wide. Paula had bred ferrets on her ranch for years. The vibrations affected the mother’s central nervous system and caused her to eat her kittens. Paula now brings action against Apex and the retailer.
