Oliver оwned Blаckаcre, which jutted оut оver steep cliffs surrounding its west, north, аnd east sides. Highland Avenue bordered the south side of the land, ending at a public beach on the west. There were steep stairs going down the cliff into the beach on the northwest corner of the property. A water line and a sewer line for Blackacre ran from Highland to Oliver’s house at the northern edge of the property. Oliver divided Blackacre in half, conveying the southern end to Sam. Oliver had a car, but no parking was allowed on Highland or anywhere nearby. Oliver kept his car at home and started driving through Sam’s land to reach Highland. One day while driving over Sam’s land, Oliver rolled his window down to wave to Sam, and Sam said to Oliver, “Good thinking, buddy. I would drive over this land too.” Oliver then dug a well on his land and stopped using water from the water line. He also sold his land, or the northern half of the original Blackacre, to Ned. Ned added a guest house on the plot with a plan to operate both the main house and the guest house as vacation rental properties. The city of late opened a public parking lot at the western end of Highland right by the beach. Sam then planned to build a guest house right by the border of his lot and Ned’s. Ned complained that the guest house was going to block the sunlight on his rose garden and kill the roses. Sam sought to cut off the water and sewer lines, and now that there was parking on Highland, also to block Ned from driving over his land to Highland. Ned complained that he needed the water line in addition to the well water with the new guest house on the property, that he had relied on the sewer line, and that the parking lot was too far from the stairs on the northwest side down to the beach. Ned and Sam sued each other, arguing for easements. Discuss. Assume that the issue of prescriptive easement does not apply.
