So, Art came up with a proposed solution to their plight. He described a story of how three individuals had walked off with a stolen painting worth millions of dollars at an Italian art museum. Although both Bill and Carl were initially reluctant, when Art pointed out that no one had been caught, they both agreed that Art’s plan was brilliant. After researching the museum on the internet, they decided to steal a Renoir located on the second story of the building. So, the following week the three men showed up at the Getty Museum of Art just before the museum was scheduled to close. According to their preconceived plan Bill gave the signal that no one else was in the room. With some difficulty, Art removed the painting from the wall and placed it in a large duffle bag with ropes attached to the canvas handles of the bag. Carl was waiting outside in his truck beneath a second story window ready to receive the painting. As Art was lowering the painting towards Carl, Bill shouted “security guard.” However, the two men were prepared for this contingency. As the security guard entered the room Bill hit him over the head with his revolver and the guard was knocked unconscious. With the painting secure in Carl’s truck Art and Bill walked out of the museum as though nothing had happened. As they were about to enter Carl’s truck however, the three men were immediately surround by security guards and soon thereafter turned over to the police. Discuss all legal issues relating to (a) Art’s proposal; (b) the agreement to pursue the plan (c) the execution of the plan in the museum; (d) Bill’s action concerning the security guard; (e) Art’s criminal responsibility for Bill’s action concerning the security guard.
