It is аn exciting time!  Yоu just lаnded yоur dreаm jоb as an Associate Athletic Director for your alma mater, the O.D. University Fighting Dolphins (ODU).  ODU is a mid-major, Division I institution in the MAC Conference.  In recent years, ODU’s softball team has experienced great success, including a trip to the Super Regionals in 2022.  With the return of the majority of its starting line-up, the Fighting Dolphins are hoping for repeated success this year.  While there are many great things going on at ODU, unfortunately, you are also inheriting a few problems.  It seems as if you have been hired just in time to inherit a lawsuit.  Let me explain!  Because ODU is a mid-major institution, it relies heavily on the work of interns.  As the Associate Athletic Director, these interns fall under your prevue.  The interns, graduate students, receive a monthly stipend of $1800 and a tuition waiver for their work.  While this seems like a nice financial perk for the interns, it isn’t without lots of hard work.  The interns do a tremendous amount of work for the athletic department including, set up for athletic contests, transporting supplies to the fields for game day operations, manning ticket booths, and tearing down when the contests are over.  During the preseason, the Fighting Dolphins softball team was hosting a 3-game weekend series.  Ivey the Intern was responsible to transport the signage to the field for game day.  Well, Ivey the Intern was not known for her punctuality.  She was running a bit behind when she received a phone call from her boss at the time (Stickler Steve, your predecessor) to hurry up with the signage.  In order to speed up the process, Ivey the Intern quickly packed the signage onto the university golf cart and raced across the parking lot towards the softball facility.  As Ivey the Intern was approaching the softball facility, she made a last-minute decision to enter the rear of the facility, rather than the front of the facility.  Ivey the Intern made a sharp turn and failed to see the Fighting Dolphins ace pitcher, Penny.  In an attempt to avoid the golf cart, Penny the Pitcher made a flying leap toward the bushes.  Whew!  It was close, but Ivey the Intern did not hit Penny the Pitcher with the golf cart.  Unfortunately, though, Penny the Pitcher sustained a torn labrum in her pitching shoulder when she landed in the bushes.  Penny the Pitcher's season was over and such an injury raises questions about her ability to pitch again.  Not only is Penny the Pitcher out for the season, but the ODU Fighting Dolphins hopes for a repeat conference title and trip to the Super Regional are dashed.  ODU subsequently fired Ivey the Intern and Stickler Steve for their roles in the accident with Penny the Pitcher.  You were just notified that ODU received notification that Penny the Pitcher is suing Ivey the Intern, Sticker Steve (your predecessor and former internship coordinator) and ODU for negligence.   Your boss, Boss Betty, has little knowledge of sport law and is calling upon your expertise to help her through this process.  Boss Betty has asked you to prepare the following information and present it to her in next week’s meeting:
