Pаrt I: Pleаse refer tо the fоllоwing scenаrio to answer questions below. On June 12, the police arrived to a call from a Harlan county roadside bar. In this bar, they found the bar owner, the caller, waiting for police to arrive. Moments prior, a local man burst into the bar and shot a customer once point blank, and then ran off. Witnesses and onlookers attempted to provide assistance to the wounded man, but he expired before police and EMS could arrive. The assailant fled the scene immediately. While taking statements the owner claimed that he was suspicious that a customer, William Prince, had ingested key evidence in the crime, but gave no proof that this occurred. Mr. Prince was a witness in another case locally and was well known to police, but had no warrants and had not been reported to have committed any crime other than possible obstruction. Police took Mr. Prince into custody but did not charge him with any crime, including obstruction of justice. The officer did not give Mr. Prince a Miranda statement, nor did the department accuse him of a crime, but told him explicitly that they would hold him until he passed the evidence. Four days have now passed with Mr. Prince in custody and he maintains that he did not ingest any evidence, but refuses to cooperate with police. He has not eaten, nor has he allowed himself relief in the four days he has been in custody. Mr. Prince has not been afforded any legal representation, as he has not yet been charged with a crime. However, the police have begun the process of forcing Mr. Prince to cooperate medically and attempted to obtain a court order to do so, even though he has not been formally charged, nor has he spoken to legal representation. After two additional days of refusing to eat or relieve himself and without a court order compelling him to comply, Mr. Prince suffers health complications and is rushed to the hospital where he is then handcuffed to his bed after extensive surgery. Mr. Prince has still not been charged with any crime, nor has he produced any evidence. Imagine that you are a supreme court judge/legislator/advocate and this case has come before you to answer the following questions.
