African American dancers who refused to work at the other club were “fined” or sent home by the owner. You are the EEOC investigator investigating this complaint. What federal statute has been violated, and what statutory factors must be established in order to create a prima facie case? In other words, identify the statute (by full name), the type of claim at issue within that statute (disparate treatment, impact, retaliation, etc.), and identify and explain each element of that claim that the EEOC would need to establish in order to proceed in a case against this company. Then (in a new paragraph), apply each of those elements to our case and arrive at a conclusion whether the statute was violated or not.
