Tinа, whо wаs unmаrried, оwned a hоuse in the city and a vacation condo in the mountains. Tina created a valid living (inter vivos) trust naming herself as trustee and providing that she had the power to revoke or amend the trust during her lifetime. The terms of the trust appointed Tina’s sister, Sarah, as her successor trustee in the event of her incapacity or death, and that the trust property be held for the benefit of Tina’s son, David, until David’s death. At David’s death, the trust was to terminate and be distributed to Sarah’s two children, Amanda and Bill. The sole asset in the living trust was the house in the city. Several years later, Tina prepared a valid Will. In the Will, Tina declared, “I hereby revoke the trust I previously established, and appoint my love, Oscar, to serve as my successor trustee, and leave my house in the city and a vacation condo in the mountains to him as well.” The following year, Tina passed away. Sarah and Oscar were cleaning out the vacation condo in the mountains when they stumbled upon Tina’s will. Upset, Sarah refused to serve as a trustee under the living trust, and claims that as a result of her refusal to act as trustee, the living trust fails, and the house in the city should be immediately given to her two children, Amanda and Bill. Oscar agreed to serve as trustee under the trust created by the Will, and claims that the house in the city is part of the trust created by the Will to be distributed according to its terms. Oscar then sells the house in the city and the vacation condo in the mountains, at fair market price, and invests all the proceeds of the sale into his new business, Mayer-Wiener Mobile, without notifying anybody. A year and a half later, Sarah finds out and files suit objecting to the sale of the house in the city and to Oscar’s investment in Mayer-Wiener Mobile.
