Sam is a convicted felon and has no particular expertise in Native art, but says that he looked into Eric’s baggage and saw what he thought were illegal Native artifacts. Sam’s information on drugs has been reliable on 5 different occasions. Paul also receives an anonymous tip on the Crime Stoppers hotline that says, “Eric is trading in illegal Native art. He flies to Native villages every Wednesday, collects the art, then returns on Thursday and dealers come to his house from midnight to 2am that night to get the art.” There is no information on this informant at all. Officer Paul legally learns that Eric lives in a log cabin on G Street, the only one on that street and legally monitors his air traffic into and out of Anchorage. For the last two months, Eric has gone each week to a different Native village in Alaska on Wednesday and returned on Thursday. On the last four occasions, Paul has staked out Eric’s house and seen people coming into and out of his log cabin with odd shaped packages from midnight to 2am. Officer Paul presents all of the above information to a neutral magistrate and is issued a search warrant that authorizes “APD to search the log cabin on G Street in Anchorage”. Paul goes to the log cabin on Tuesday at noon, knocks on the door and loudly announces “I am an APD officer, open the door”. He hears scuffling and other activity but no one answers the door for 1-2 minutes. Paul then kicks in the door and after he enters, loudly says “I have a search warrant”. He sees Eric trying to throw Native art into the fire in the fireplace. He secures Eric, searches the house and finds lots of illegal Native art, and charges Eric with that crime. Eric challenges both the validity and particularity of the search warrant and argues that the evidence of the illegal art found should be suppressed.
