To transport the cash Albert always uses a distinctive neon orange bag with a giant gold money symbol on the outside so he never loses the bag. Before going to the bank Albert always stops at his favorite gelato stand to have a quadruple gelato and ice cream. Albert recently fired longtime GOLD Store employee, Bob, for suspected theft of cash. Albert did not report the suspected theft to the police but told Bob that the theft would be reported if Albert ever saw Bob again. Bob was angry that he got fired and threatened Albert. Last Friday, Albert followed his usual routine and went to the bank with his distinctive neon orange bag with a giant gold money symbol on the outside. Inside the bag was $76,000 of cash currency from the previous week. Albert of course stopped at his usual gelato stand. Unknown to Albert, Bob is also at the stand enjoying a triple gelato and nursing his feelings about getting fired. Bob sees Albert and the money bag and decides that he is owed severance pay and decides that he is going to take the money bag from Albert. However, Bob decides that there is not a good way to steal the money bag. Instead, Bob quickly devises a plan to get an apology and to throw his gelato cup at Albert to get Albert’s suit dirty. Bob approaches Albert who gets scared and tries to leave the water ice stand to avoid speaking with Bob. This upsets Bob who chases Albert into a corner of the stand where Albert is trapped and cannot get out. Bob tells Albert that he is trapped and that Bob intends to keep Albert trapped until Albert apologizes. Albert refuses but is prevented from leaving, and Bob keeps Albert trapped in the corner for approximately 10 minutes while he demands an apology. Bob gets frustrated at Albert’s failure to apologize and throws the gelato cup intending to hit Albert. The cup misses Albert and hits Carl, another patron, who is covered in gelato and is highly offended by being touched and hit with the cup and covered in gelato.   Please Discuss: Discuss what crimes, if any, Bob can be charged with and remember to discuss the mens rea and actus reus for any crimes discussed.
