Beck аnd Mаddie аre hоneymооning on the Island of Kauai. They are out for a drive in the less populated part of the island when they happen upon two hitch-hiking males. Maddie, ever the kind-hearted optimist, convinces a reluctant and skeptical Beck to pull the car over and give the males a ride. The males introduce themselves as Andy and Carl; they appear friendly. Andy sits in the passenger side of the back seat behind Maddie, while Carl sits in the driver’s side of the back seat behind Beck. Carl explains that he and Andy are renting a VRBO home and were out hiking but became exhausted and just want to get back the rental. Andy insists the rental is not far and gives Beck directions thereto. Andy tells Beck to make a right down a secluded road and says it’s not far. Approximately one mile later Beck pulls up to a lone house – a large and impressive house. At this point Andy’s voice changes and he is no longer friendly; neither is Carl. Andy reaches forward and grabs Maddie by her ponytail, pulls her head back and places a large hunting knife against her throat. Andy tells Beck that he (Beck) and Carl are going to break into this house and take whatever valuables they can find. Andy explains that he and Carl did not rent the house but had cased it earlier and it seems well furnished. Carl then adds, “The house appears to have interior motion activated surveillance cameras and therefore, I will mask up, but you will not.” Beck refuses to participate, until Andy presses the knife more firmly against Maddie’s throat and asks, “Do you want to live without her?” Beck then acquiesces. Carl tells Andy that Beck seems too nervous and does not trust that Beck will do exactly as told once inside the house. Carl therefore hands Beck two white capsules containing LSD and says, “If you want Maddie to live, swallow these and follow me.” Beck complies. Immediately after swallowing the pills, Beck feels lightheaded and enters a dreamlike state of mind where nothing seems real. Carl exits the backseat; opens the driver’s door and orders Beck out. Beck complies. After Beck and Carl enter the house through an unlocked window, Andy sees the property’s caretaker appear and walk toward the front door of the house. Andy exits the car and approaches the caretaker in a friendly manner to put him at ease. Just then, Carl and Beck exit the house carrying jewelry and other valuables. The caretaker sees them and grabs his cell phone to call police. Andy and Carl then rush upon the caretaker. The caretaker fights back admirably, until Andy stabs the caretaker repeatedly with his hunting knife, killing him. Meanwhile Beck had fled back to the car and quickly drove off with Maddie still in the front passenger seat – traumatized, but otherwise physically unharmed. After getting back on the main road and driving a few miles thereon, a police officer sees Beck’s erratic driving and pulls him over. Beck lethargically attempts to explain what just happened and that he was driving to save their lives. The officer is skeptical and suspects Beck of Driving Under the Influence of Drugs. He evaluates Beck for same and arrests Beck thereafter. Beck’s blood later tests positive for LSD metabolites. Andy and Carl are later arrested while hiding approximately one mile from the crime scene. Assume the above events occurred in a Common Law jurisdiction.
