LA541x – Cаpps – Fаll 2026 Tоrts 1 Midterm Essаy Exam A lоcal university оperates a large student recreation center that includes basketball courts, exercise rooms, and an indoor swimming pool. The university employs Mark as the evening supervisor of the recreation center. One Friday afternoon, a university employee delivered several boxes of new exercise equipment to the recreation center. Mark opened the boxes and placed the equipment in the appropriate storage room. After doing so, Mark left a large, empty cardboard shipping box lying on the floor immediately outside the storage room door. The box was approximately four feet long and three feet wide. Because the hallway was frequently used by students walking between the basketball courts and locker rooms, university policy required employees to keep the hallway free of equipment, boxes, and other obstructions. Mark knew about the policy. He intended to move the box to a recycling area but became distracted when his girlfriend called him. Mark walked into his office and talked on the telephone for approximately twenty minutes. During that time, Sarah, a student, was walking down the hallway toward the locker room. Sarah was reading a text message on her phone while walking and did not see the box. She tripped over it, fell hard onto the tile floor, and fractured her wrist. Had Sarah been looking straight ahead, the box would have been plainly visible from several feet away. Mark heard Sarah fall and came into the hallway. Embarrassed that he had left the box there, Mark said, "Maybe you should watch where you're going instead of staring at your phone." Sarah became angry and replied, "Maybe you should learn how to do your job." Mark became irritated. Standing approximately six feet away from Sarah, he picked up a basketball and said, "Keep talking like that and I might teach you some manners." Sarah saw Mark holding the basketball but did not believe he was going to throw it. She replied, "You're ridiculous," turned her back to Mark, and began walking away. Without saying anything else, Mark threw the basketball at Sarah's back. Because Sarah was facing away from him, she never saw the ball coming. The basketball struck Sarah between the shoulder blades. It did not cause any additional physical injury, but Sarah immediately turned around and yelled, "Did you just throw that at me?" Mark laughed and said, "Relax. It's just a basketball." Sarah told Mark she was going to report him to the recreation center director and started toward the director's office. Mark stepped into a small equipment room ahead of Sarah and said, "Come in here for a second. I want to explain what happened before you go making a big deal out of this." Sarah entered the room voluntarily. Once Sarah was inside, Mark stepped outside, closed the door, and held the door handle from the other side so Sarah could not open it. The room had no other door or accessible exit. Sarah immediately tried the handle and said, "Mark, open the door." Mark responded, "Give me thirty seconds to think." Sarah said, "I'm serious. Let me out." Mark continued holding the door shut. Approximately forty-five seconds after closing the door, Mark released the handle and opened it. Sarah walked out and said, "You can't lock me in a room." Mark responded, "It wasn't even a minute. Stop being so dramatic." Sarah then told Mark that she was going to report everything that had happened. Mark knew that Sarah was extremely proud of having recently been selected for a prestigious university scholarship. In front of approximately fifteen students who had gathered nearby, Mark loudly said, "Go ahead. Maybe I'll tell everyone that you cheated to get that scholarship. That's probably the only reason you got it anyway." The accusation was completely false, and Mark knew it was false. All of the students laughed. Sarah became embarrassed and began crying. She left the recreation center and called her roommate to tell her what had happened. For the next several days, Sarah was upset whenever she thought about the incident and avoided the recreation center because she did not want to encounter Mark. She continued attending classes, studying, spending time with friends, sleeping normally, and performing her ordinary daily activities. She did go to the university’s counseling office to see a counselor. Sarah consults an attorney concerning the events at the recreation center. Discuss all of Sarah’s potential claims against Mark and any arguments that may arise.
