Dоn wаs а bit dоwn оn his luck. Eаrlier that day he had been fired from his Small Town bank job despite 27 years of faithful service. The next day, Don walked into the branch, walked up to the bank teller, Vicki, and told her to fill the bag up with cash or else he would shoot her. Vicki filled the bag up with the cash from her teller drawer and then Don decided to take Vicki as hostage. Don bound Vicky’s hands and blindfolded her before heading to his car with the money. Don fled the scene with both Vicki and the cash but was quickly spotted by a police officer who initiated a traffic stop. Right after the lights and siren activated, Don increased his speed to over 100 miles per hour and sped through multiple intersections despite there being several red lights and stop signs. The police officer remained in hot pursuit. Unfortunately, Don lost control of the vehicle and crashed into a tree, killing Vicki. Small Town is a common law jurisdiction that recognizes modern distinctions where applicable. Should Don be charged with the murder of Vicki?
