The stаte оf Flоridа hаs experienced an uptick in the number оf accidents involving electric bikes (e-bikes). Some of these accidents have resulted in brain injury or been fatal for the e-bike rider. To address this issue, the state legislature passes a law requiring all e-bike riders, regardless of age, to wear a bicycle helmet that is properly fitted and fastened securely upon the passenger’s head by a strap. The law defines "e-bike" as "a bicycle or tricycle equipped with fully operable pedals, a seat or saddle for the use of the rider, and an electric motor of less than 750 watts." In passing this law, the state included findings by multiple peer-reviewed studies showing that wearing a properly fitted and securely fastened by a head strap can reduce brain injury and fatalities stemming from bicycle, including e-bike, accidents. Does the state have the authority to enact this law? Explain. Consider and discuss how a court might evaluate this law if it were challenged in court.
