Once he is out on bond, he goes to a lawyer’s office to attempt to retain an attorney. He is telling attorney Smith about how he gets excited just looking at a child and he cannot control himself. He states he would like to plead not guilty by reason of insanity. The lawyer finally tells the man that he is repulsive and he will not represent him! The secretary has overheard the entire conversation and tells her husband, the lead Detective in the case. He tells the prosecutor to subpoena his wife, as she has some great information. May the wife/secretary testify? Why or why not?
