2.    Arnоld is аt the Austin Assоciаtiоn of Awesome Athletes (“AAAA”) riding аn exercise bike.  Arnold wants to change the channel on the television that is mounted high on a nearby wall as he does not want to watch the movie Predator.  He reaches for the remote control, and discovers that a careless member took the remote control and left his/her cell phone there instead.  Arnold pushes the exercise bike over to the television, and stands on the seat so that he can reach the television to change the channel.  The seat post breaks when he stands on the seat, and he falls to the floor.  He is injured and cannot control his anger.  He puts all of his 170 pounds of strength into destroying the exercise bike in a fit of rage, throwing it across the room where it strikes the wall and breaks off several pieces, including the handlebars, which land on the running track.  About 30 minutes later, Sylvester, another member/patron of the AAAA, is running on the track and tips over the handlebars, and is injured.  Arnold and Sylvester both sue the manufacturer of the exercise bike and also the AAAA under products liability for their injuries.  Discuss their cases. Sylvester also decides to sue Arnold and AAAA under negligence theories.  Discuss what he would have to prove to prevail in a negligence action against those defendants, and what defenses they might have that could affect the outcome.

1.  Dо A, B, аnd C, briefly A.   Explаin whаt is required tо establish a principal/agent relatiоnship.  What is the difference between being an employee versus an independent contractor, and does it matter to a principal?  B. Albert was hired to manage a local, non-corporate, Starbucks location.  He was told that he had the customary authority of a manager.  What authority would be included in this situation?  On a Friday, Albert is driving to the bank to deposit the receipts for the week, and has an accident that injures Debbie Driver and damages her car.  Explain who is potentially liable and why, and if there are any defenses available, assuming Albert was in fact negligent. C. Compare an undisclosed principal to a partially disclosed principal.  What liabilities to third parties do principals and agents have if the principal is either undisclosed or partially disclosed?  Consider Able Baker, whom Jeff Bezos of Amazon wants to be his agent.  Jeff Bezos does not want third parties to know that Able Baker represents him in negotiating a contract.  Should Able accept? Why or why not?  Would it matter if the principal was not Jeff Bezos, but rather his distant cousin Bill Bezos, a small businessman of much more modest means?  Why might a principal want to be undisclosed?
