Able аnd Bаker bоth оwned lаnd with a cоmmon boundary. Baker’s land was uphill from Able’s land. A natural stream flowed across Baker’s land and downhill on to Able’s land where it fed into a small lake also owned by Able. Able lived on his land and rented boats for rowing and fishing on his lake. Baker used his land to steam clean the engines on heavy equipment including semitrucks, bulldozers, and backhoes. Baker had built a large concrete pad on which the engines of the heavy equipment were cleaned with high pressure steam hoses. The concrete pad was sloped so that the runoff from the engine cleaning business ran into the stream. After Baker had run his engine steam cleaning operation for a period of time, the oil, sludge and other debris washed into the stream by Baker began to accumulate in the lake on Able’s property. As a result, the fish in the lake died and the lake began to stink so badly that Able had to close his business and move away. The closure of Able’s business cost Able $7,000.00 per month. Able also had to rent a place to live at a cost of $3,000.00 per month. Discuss cause(s) of action available to Able against Baker, and legal and/or equitable remedies available to Able.
