Gretchen is а primаry cаre physician emplоyed by Callоus Hоspital Corporation (CHC). She works alongside many other physicians, and oversees the work of many other healthcare professions when performing surgeries at CHC. Answer BOTH of the following (A & B): A. Gretchen has been promoted to chair of the Primary Care Department, following the vote of the 30 physicians in this Department. The Board of Directors of CHC must approve all promotions to administrator positions, including for physician department chairs. As is its usual practice, the Board reviews the education, experience and recommendations of physicians voted to chair positions—Gretchen’s are stellar. However, a number of Board members are concerned that Gretchen’s commitment to CHC and the Department might not be permanent since they’re aware that she’s been discussing with colleagues the possibility of having a second child. The Board decides NOT to approve Gretchen’s appointment as chair of the Primary Care Department. Is this decision and its reason permissible? If not, what law might it violate, and how? (2-3 sentences) B. Gretchen is concerned about the disparity in treatment between physicians employed by CHC like her, and those who have clinical or surgical privileges but are not employed by CHC. These non-employed physicians are given better on-call schedules, a daily food allowance of $60 in the CHC food court, and free access to the CHC fitness center. Employed physicians often get stuck with worse hours, are given no additional funding for the CHC food court, and must pay for access to the CHC fitness center. Gretchen decides to approach a physicians’ union, Physicians of America, and attempt to unionize the physician employees of CHC. She helps to schedule a vote for unionization by these employees and prints advocacy materials for physician employees to encourage them to vote “yes” for unionization. The CHC Board of Directors is understandably not happy with this prospect. They threaten to fire Gretchen unless she stops advocating for unionization, remove all pro-union materials from employee spaces in the hospital, require any vote to take place at 3am on a Sunday morning, and tells all employed physicians that if they unionize CHC will provide additional benefits to non-employed physicians and cut benefits already held by employed physicians. Is CHC permitted to taken any of these actions, and why or why not? If the employed physicians vote against unionization, can Gretchen and Physicians of America take any action in response, and what is that action? (2-3 sentences)
