The windmill had been damaged as a result of contact with Trey and stopped spinning. As a result there was no energy to pump water into the purification tank or to operate the tank’s filtration system. Later that day Lanny thought the water pressure in his home had dropped. He went to the windmill and saw that it was inoperable. He then checked and discovered that the purification tank was about two-thirds full. Lanny called for service to the windmill and was told that a repair person was not available until the next week. On Friday, Lanny was visited by Pastor wishing to invite Lanny to attend Sunday services at his church. While in Lanny’s farmhouse, Lanny offered Pastor a glass of water. Pastor remarked that the water “smelled funny,” and did “not taste good.” After leaving Lanny, Pastor grew very ill and was hospitalized. He informed Lanny about the water. Lanny tested the water in the tank and found that it was growing bacteria as a result of the inoperable filtration system. On Saturday, as was his practice, Lanny opened his property to the public for a ‘farmer’s market.’ He was busy selling produce and forgot about the problems with the tap water. Paula, a shopper at the market, drank from an accessible drinking fountain connected to the increasingly foul purification tank. She became ill and was hospitalized. On what theory or theories, if any, can Lanny be found liable to Trey? Liable to Pastor? Liable to Paula? Discuss fully.
