Stаte’s Legislаture wаs cоncerned with the quality оf services prоvided by tax preparers in the State. Studies relied upon by the Legislature disclosed disproportionately high rates of tax return audits by State and federal tax authorities as compared with other states. The Legislature passed, and the Governor signed, a statute mandating that all tax preparers become Certified Tax Specialists (“CTS”) licensed by State to lawfully prepare and file tax returns. To be certified, a person must complete an exclusive two-year course of study at State University and pass a written examination administered only by the University. State University has two campuses, North Campus and South Campus. They are located, respectively, in the north and south of State. South Campus is coed but North Campus was established in the early 20th Century as a nurses’ and teachers’ college for women, only. Legislature, facing substantial budget deficits, has been unable to appropriate funds to upgrade the North Campus facilities to accommodate a coed student body. Able is a non-degreed bookkeeper who makes nearly all of her income preparing tax returns for families and small businesses. She fears that the CTS statute will put her out of business. Baker, who resides near the North Campus, desires to become a CTS. As a recent high school graduate, relocating to the south of State is financially prohibitive. Baker has been informed that as a male he cannot be accepted to the North Campus or into its CTS program. Charlie, a Woman of Color, lives in the eastern part of State, the population of which is mostly People of Color. She desires to become a CTS but it is impractical for her to relocate her family to the northern or southern regions of State to attend either of the State University CTS programs. She fears that the communities in the geographically distant eastern area of State will be underserved by the new CTS mandate. Able, Baker, and Charlie each seek to challenge the CTS statute in State courts.
