Oliviа оwned аn оld hоuse thаt had been the home of her family for more than 200 years.  Olivia was born and raised in the house, and it was the source of her fondest memories; most of her ancestors were buried in the house’s backyard.  The state decided to establish a new state college on a 500-acre tract, which included Olivia’s property on its outer edge.  The design plan called for the site of Olivia’s house to become part of the parking lot for the campus security office.  The other affected landowners in the region voluntarily sold their properties to the state.  But Olivia refused to sell for any price.  The state then filed an eminent domain action to take Olivia’s property.  Who will win the lawsuit?

The tоwn оf Quiet City hаs аn оrdinаnce that forbids the use of any outdoor speakers to play any kind of music at any time during the day.  Sam Silent is the town founder and leader of the “Silence is the best policy” movement.  One day, Barry “Drop That Bass” Bassman moves into the home next door to Sam.  Barry previously lived in the adjacent city where he owned an outdoor nightclub called “Dancin’ Under the Stars.”  Barry wants to open a similar club in Quiet City.  Barry is mindful of the ordinance forbidding the use of outdoor speakers.  Because he decides this is a violation of his constitutional right to play “sick beats,” he decides to soften the community by playing loud music in his backyard from 5 pm to 9 pm every night in hopes to change peoples’ attitudes.  Sam obviously hears the music every night and gets really upset.  He immediately seeks a preliminary and permanent injunction against Barry to stop the outdoor music. Judge Peace, like most people in Quiet City, hates loud music and respects Sam.  Judge Peace grants the preliminary injunction thereby forbidding Barry from playing music outdoors.  Barry believes Judge Peace made a mistake by disregarding his rights and decides to disregard the order.  Without holding a trial, Judge Peace holds Barry in contempt, fining him $500 for each day he continues to play music outdoors.  Barry continues to play the music for 5 additional days until it is ultimately determined by a different judge that the ordinance is unconstitutional.  The court determines that a permanent injunction should not be issued.  Furthermore, the court also determined the preliminary injunction should be dismissed. Discuss whether Judge Peace’s granting of the preliminary injunction was appropriate and whether Barry must pay the $2,500 fine.
